Under the New Jersey Code of Criminal Justice, embezzlement is called theft by failure to make required disposition of property received. New Jersey law treats this crime as a type of theft offense. Embezzlement occurs when a person entrusted with property takes that property for personal use. While anyone entrusted with property can commit embezzlement, it is more common among white-collar employees because of the large amounts of property and greater discretion with which they are entrusted. Embezzlement carries the same penalties as other theft offenses, which usually depend on the value of the property involved:
- $75,000 or more: 5 to 10 years in prison
- $500 to $74,999: 3 to 5 years in prison
- $200 to $499: Up to 18 months in prison
- Less than $200: Disorderly persons offense
A person convicted of embezzlement may also face fines and may be required to make restitution for the property wrongfully obtained.
